Amendments, Water Quality Certificates, and Other Permits

FERC’s amendment process was designed to incorporate other federal, state, and local agency reviews. Use the FERC pre-filing consultation process to the extent possible to apply for and obtain all other agency permits needed before you file your amendment application. When this is not possible due to overlapping or conflicting agency requirements, continue working to obtain FERC’s approval and any other agency permits at the same time. Many permits can be obtained after the FERC order amending the license has been issued (but not a state water quality certificate or a biological opinion under the Endangered Species Act). FERC’s order approving an amendment will require the licensee to obtain all other necessary federal, state, and local permits before FERC will authorize the start construction.

After determining an amendment is needed, when should PG&E start pre-filing consultation with federal, state, and local agencies per FERC’s regulations under 18 CFR 4.38? When, relative to the FERC approval process, should PG&E apply for any required non-FERC permits, including a Water Quality Certificate from the State of California? Should PG&E apply for any non-FERC permits before, at the same time, or after filing an amendment application with FERC? Does it depend on the type of permits?
